AI Disclaimer & Limitations

Nature of AI-Generated Results. The ASEB AI Visibility Suite uses Claude AI (Anthropic) and Google Lighthouse to generate visibility scores, analysis, recommendations, and content briefs. These results are generated algorithmically and may contain inaccuracies, outdated information, or errors.

Specifically, you acknowledge that:

• AI-generated scores, narratives, and recommendations are estimates based on available data and may not reflect the complete picture of your business's visibility
• The "What AI Actually Sees" section shows one AI model's (Claude) response and may differ significantly from ChatGPT, Gemini, Perplexity, or other AI engines
• Share of Voice and competitor data are modeled estimates, not real-time query monitoring across AI platforms
• Sentiment analysis reflects algorithmic assessment based on available site data, not actual user or customer sentiment
• Google Knowledge Graph and Rich Results data is pulled from Google's public APIs and may not reflect real-time indexing status
• Core Web Vitals and performance data from Google Lighthouse represent a single test at a specific point in time and may vary between tests
• Content briefs and action plans are suggestions based on general best practices, not guarantees of improved performance

No Guarantee of Results. ASEB Consulting makes no warranty, express or implied, that implementing any recommendation provided by this tool will result in improved search rankings, AI visibility, website traffic, or business outcomes. Digital marketing and AI optimization involve complex, dynamic systems outside our control.

Third-Party AI Platforms. This tool does not have access to the internal algorithms, training data, or ranking systems of ChatGPT, Google Gemini, Perplexity, Microsoft Copilot, or any other third-party AI platform. Any analysis of how your business appears on these platforms is based on inference and publicly available information, not direct platform access.

Terms of Service

Acceptance of Terms. By accessing or using the ASEB AI Visibility Suite ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Eligibility. You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or your business to use this Service.

Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify ASEB Consulting immediately of any unauthorized access.

Acceptable Use. You agree to use the Service only for its intended purpose of analyzing your own business's AI visibility. You may not:

• Use the Service to analyze competitors' businesses for competitive intelligence at scale
• Resell, redistribute, or white-label the Service or its outputs without written permission from ASEB Consulting
• Attempt to reverse engineer, scrape, or automate the Service beyond its intended use
• Use the Service for any unlawful purpose
• Share account credentials with third parties

Service Availability. ASEB Consulting strives to maintain service availability but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Modifications to Service. ASEB Consulting reserves the right to modify, update, or discontinue any feature of the Service at any time. We will make reasonable efforts to notify subscribers of material changes.

Billing, Refunds & Cancellation

Subscription Plans. The ASEB AI Visibility Suite is offered on a monthly subscription basis at the rates displayed at the time of purchase. Prices are in USD and are subject to change with notice.

Free Tier. The free tier provides one complimentary audit and is subject to availability. ASEB Consulting reserves the right to modify or discontinue the free tier at any time.

Cancellation Policy. You may cancel your subscription at any time through your account settings or by contacting us at support@asebconsulting.com. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• Access to paid features will continue until the end of the paid period
• No partial refunds will be issued for the remaining days of the current billing period
• Your audit history will be retained for 90 days after cancellation, after which it may be deleted

Payment Processing. All payments are processed securely through Stripe. ASEB Consulting does not store credit card information. Your payment is subject to Stripe's terms of service and privacy policy.

Failed Payments. If a payment fails, we will attempt to process it again. If payment cannot be collected, access to paid features will be suspended until payment is resolved.

Limitation of Liability

No Consequential Damages. To the maximum extent permitted by law, ASEB Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business, loss of data, or damage to reputation, even if we have been advised of the possibility of such damages.

Disclaimer of Warranties. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Third-Party Services. The Service integrates with third-party APIs including Google PageSpeed Insights, Google Knowledge Graph, Anthropic Claude, and others. ASEB Consulting is not responsible for the accuracy, availability, or results of these third-party services.

Website Changes & Recommendations

Review Before Implementing. All technical recommendations, developer notes, fix instructions, and action plans provided by this tool should be reviewed by a qualified web developer or digital marketing professional before implementation. We strongly recommend testing any changes in a staging environment before applying them to a live website.

No Technical Support. The ASEB AI Visibility Suite provides recommendations, not implementation services. Unless you have engaged ASEB Consulting directly for implementation services under a separate agreement, we do not provide technical support for implementing the recommendations in these reports.

Best Practices Only. All recommendations are based on general AI optimization and SEO best practices at the time of the audit. Industry standards change frequently. ASEB Consulting makes no guarantee that following these recommendations will produce specific outcomes.

• We are not responsible for website downtime, errors, or data loss resulting from changes made based on our recommendations
• We are not responsible for changes in search engine rankings resulting from actions taken based on our reports
• We are not responsible for changes in how AI engines represent your business following implementation of recommendations
• We are not responsible for any security vulnerabilities introduced through implementation of our technical recommendations
• We are not responsible for any third-party costs incurred while implementing recommendations (hosting, plugins, developer fees, etc.)

Privacy Policy

Information We Collect. When you use the ASEB AI Visibility Suite, we collect the following information:

Information you provide directly:

• Name, email address, and password when creating an account
• Business name, website domain, city, and industry when running an audit
• Phone number (optional)
• Payment information (processed securely by Stripe; we do not store card details)

Information collected automatically:

• Audit results and scores generated by the Service
• Usage data including audit dates, frequency, and tier
• IP address and general location data
• Browser type and device information

How We Use Your Information. We use collected information to:

• Provide and improve the ASEB AI Visibility Suite
• Process payments and manage your subscription
• Send you audit results, account notifications, and service updates
• Add you to our CRM (Vendasta) for follow-up communications and service offerings
• Send educational content and ASEB service recommendations relevant to your audit results
• Analyze usage patterns to improve the Service
• Comply with legal obligations

Information Sharing. We do not sell your personal information to third parties. We may share your information with:

• Stripe for payment processing
• Supabase for secure data storage
• Anthropic's Claude API for generating AI analysis (your business data is sent to Claude for analysis)
• Google APIs for PageSpeed and Knowledge Graph data
• Vendasta for CRM and email communications
• Law enforcement when required by law

Data Retention. We retain your account data for as long as your account is active. Audit history is retained for 90 days after account cancellation. You may request deletion of your data by contacting support@asebconsulting.com.

Your Rights. You have the right to access, correct, or delete your personal data. Contact us at support@asebconsulting.com to exercise these rights.

Data Collection & Security

Security. We implement industry-standard security measures to protect your data including encrypted data storage via Supabase, secure payment processing via Stripe, and HTTPS encryption for all data transmission. However, no method of transmission over the Internet is 100% secure.

Cookies. The ASEB AI Visibility Suite uses browser local storage to maintain your login session. We do not use tracking cookies for advertising purposes.

Children's Privacy. This Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors.

Changes to Privacy Policy. We may update this Privacy Policy from time to time. We will notify you of material changes by updating the effective date at the top of this document and, where appropriate, by email.

Governing Law. These Terms and Privacy Policy are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Lee County, Florida.
